These Terms of Service ("Terms") govern your access to and use of the InStore Steals website, application, tools, Discord community, and all related services (collectively, the "Service") operated by Jigged, Inc. ("Company," "we," "us," or "our"), a company registered in the United States.
By creating an account, subscribing, or using any part of the Service, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree to all of these terms, do not use the Service.
InStore Steals is a subscription-based software tool that aggregates publicly available retail clearance, pricing, inventory, and aisle-location data from third-party retailers. We are not a retailer, reseller, affiliate, partner, or authorized representative of any retailer, including but not limited to The Home Depot or Costco Wholesale. We do not sell physical products, set retail prices, or guarantee the availability of any item at any store.
The data we display is sourced from publicly accessible information. Prices, stock counts, aisle locations, and product availability can change at any time without notice, including between the time we retrieve the data and the time you visit a store. We make reasonable efforts to keep data current but do not guarantee the accuracy, completeness, or timeliness of any information displayed.
You acknowledge that purchasing decisions are yours alone, and the Company bears no responsibility for wasted trips, out-of-stock items, price discrepancies, or any other loss arising from reliance on data shown in the Service.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into these Terms, and that all information you provide is accurate and truthful.

You are solely responsible for all activity that occurs under your account. The Company is not liable for any loss or damage arising from unauthorized use of your account.
The Service is offered on a monthly subscription basis at the rate displayed on our website at the time of purchase. Subscriptions are billed monthly through Stripe, our third-party payment processor. By subscribing, you authorize recurring monthly charges to your payment method until you cancel.

If you participate in our Discord server or any other community channel associated with the Service, you agree to the following standards of conduct. Violation of any of these rules may result in immediate and permanent termination of your account, subscription, and community access, without refund and without prior warning:
We reserve the sole and absolute right to determine what constitutes a violation of these rules. We may remove any content and suspend or terminate any user from the community and the Service at our sole discretion, with or without prior notice, for conduct we determine to be harmful, disruptive, inappropriate, or in violation of these Terms.
By posting in our community, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, modify, and delete any content you post for the purpose of operating, moderating, and improving the community and the Service.
We reserve the right to suspend or terminate your account, subscription, and access to the Service, in whole or in part, at any time, for any reason, including but not limited to:
Upon termination for cause, no refund will be issued for any remaining time on your subscription, and any unused service credits, quota, or entitlements are forfeited. We may also permanently ban you from creating future accounts.
You may terminate your account at any time by canceling your subscription from your account settings. To request complete deletion of your account and personal data, email support@instoresteals.com.
Termination does not relieve you of any obligation to pay fees incurred prior to termination.
We reserve the right to modify, update, suspend, or discontinue any part of the Service, including features, tools, data sources, supported retailers, coverage areas, and usage quotas, at any time, with or without notice, and without liability to you. No modification, suspension, or discontinuation of any feature or functionality entitles you to a refund or credit.
All content, software, code, design, user interfaces, branding, trademarks, logos, and other intellectual property associated with the Service are owned by Jigged, Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property except the limited, non-exclusive, non-transferable, revocable right to use the Service as a paying subscriber for your personal, non-commercial use.
You may not use our name, logo, trademarks, or branding for any purpose without our prior written consent. You may not frame, mirror, or create derivative works from any part of the Service.
The Service integrates with third-party services including Stripe (payment processing), Discord (community and authentication), and email delivery providers. Your use of these services is subject to their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.
The Service displays data from third-party retailers. We have no control over retailers' pricing, inventory, store operations, policies, or decisions. Retailers may change prices, remove clearance items, alter inventory, modify store layouts, or take any other action at any time without notice to us. The Company is not responsible or liable for any action or inaction by any retailer.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, ERROR-FREE, OR SECURE; (B) ANY DATA, PRICING, INVENTORY, AISLE, OR AVAILABILITY INFORMATION WILL BE ACCURATE, COMPLETE, RELIABLE, OR CURRENT; (C) ANY ITEM WILL BE AVAILABLE FOR PURCHASE AT THE PRICE, QUANTITY, OR LOCATION SHOWN; (D) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS; (E) ERRORS WILL BE CORRECTED; OR (F) THE SERVICE WILL BE FREE OF VIRUSES OR HARMFUL COMPONENTS.
YOU USE THE SERVICE AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JIGGED, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, WASTED TRIPS, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE LESSER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless Jigged, Inc. and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or third-party right; (d) any content you post in community channels; or (e) any dispute between you and a third party, including any retailer.
Binding Arbitration: You and Jigged, Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Disputes") shall be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring an individual action in small claims court if the claim qualifies.
Class Action Waiver: YOU AND JIGGED, INC. EACH WAIVE THE RIGHT TO A TRIAL BY JURY. YOU AND JIGGED, INC. EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS-WIDE ARBITRATION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR ANY OTHER REPRESENTATIVE PROCEEDING. You may only resolve Disputes on an individual basis.
Arbitration Rules: Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitrator's decision shall be final and binding.
Informal Resolution First: Before initiating arbitration, you agree to first contact us at support@instoresteals.com and attempt to resolve the Dispute informally for at least 30 days.
Opt-Out: You may opt out of this arbitration provision by sending written notice to support@instoresteals.com within 30 days of creating your account. If you opt out, Disputes shall be resolved in the courts of Luzerne County, Pennsylvania.
These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict-of-law provisions. To the extent litigation is permitted, exclusive venue shall be the state or federal courts in Luzerne County, Pennsylvania.
By creating an account, you consent to receive electronic communications from us (sign-in links, service notices, billing confirmations, policy updates). You agree that these satisfy any legal requirement that communications be in writing. You may not opt out of transactional or service-related communications while maintaining an active account.
We shall not be liable for any failure or delay in performing our obligations where such failure results from events beyond our reasonable control, including natural disasters, pandemics, acts of government, war, terrorism, power failures, internet or telecommunications failures, cyberattacks, third-party service outages (including retailer systems, Stripe, Discord, or hosting providers), or any other force majeure event.
If your account has no active subscription and has not been accessed for twelve (12) months or more, we may deactivate and delete your account and associated data after providing 30 days' notice to your email. You may prevent deletion by signing in within the notice period.
You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations under these Terms at any time, including in connection with a merger, acquisition, or sale of assets. These Terms bind and benefit the parties and their successors and permitted assigns.
We may update these Terms at any time. We will update the "Last updated" date and make reasonable efforts to notify you of material changes at least 14 days before they take effect. Continued use constitutes acceptance. If you disagree, your sole remedy is to cancel.
If any provision is held invalid or unenforceable, it shall be enforced to the maximum extent permissible, and the remaining provisions remain in full force.
Our failure to enforce any right or provision shall not constitute a waiver. Any waiver must be in writing. A waiver on one occasion does not waive enforcement on any other occasion.
Sections 5, 9, 11, 12, 13, 14, 15, 19, 22, and this Section 23 survive termination of these Terms.
These Terms, our Privacy Policy, and our Refund Policy constitute the entire agreement between you and Jigged, Inc. regarding the Service, superseding all prior agreements.
